House passes legislation shielding employee benefits from DEI policies

The House of Representatives has passed H.R. 5339, the Protecting Americans’ Investments from Woke Policies Act, which includes Congressman Bob Good’s (VA-05) No Discrimination in My Benefits Act. The vote concluded with 217 in favor and 206 against. The legislation aims to ensure that fiduciaries of employee benefits plans select their employees based on traditional prudence and loyalty standards rather than Diversity, Equity, and Inclusion (DEI) policies.

The No Discrimination in My Benefits Act emphasizes the importance of selecting service providers on a nondiscriminatory basis, prioritizing the financial well-being of employee benefit plans. The bill amends the Employee Retirement Income Security Act (ERISA) to explicitly state that race, color, sex, or national origin should not influence the selection of fiduciaries, counsel, employees, or service providers.

“Hard-working Americans want the most competent and knowledgeable person to manage their benefits. They want to know their assets are safe and that they will have a good return on investment,” said Good. “Under the Biden-Harris regulatory agenda, the main priority is not the best interest of the American public but rather DEI. I believe using someone’s race or sex to determine someone’s eligibility for benefits is wrong. The ESG investing agenda is in direct opposition to American principles, and my bill will protect Americans and their benefits from Washington bureaucrats.”

This marks Rep. Good’s fourth bill of the 118th Congress to pass on the House floor.
